Is it fraud if a Canadian Citizen is applying for US Citizen sponsorship stating they are living together?

This two people are having an affair. She has requested the services of an immigration lawyer to try to obtain sponsorship either her sponsoring him or he sponsoring her but they are applying as common law couple when in reality the man is still and has always been living with the wife and she is unaware of the situation. If she finds out can she report them to Customs? Or will they be able to get away with it without her knowledge?

Yes it is perjury because those statements are made under oath. And yes anyone that has information about a false statement can report what they know to the INS.
