Is it legal? ...non-refundable handling fees on canceled concerts in OK?

Postby chatima » Mon Mar 30, 1998 5:18 pm

A music band cancelled a concert here in Tulsa, Oklahoma. ProTix refused to refund the handling fee or the tickets I purchased online. Is this legal in Oklahoma?

Also, this is the full extent of the warning about non-refundable fees when purchasing a ticket online (save for a number to call if you have more questions): "All sales are final. There are no refunds or exchanges unless a show has been cancelled or rescheduled. Be advised that your purchase will include handling fees." So there is no explicit mention.

Note that during the ticket buying process, it never suggests you visit the Policies page to learn about non-refundable fees. If you do, for some reason, decide to investigate the website, then you may find that Policies page where this is written: "...handling fees. These fees may be non-refundable."

Even if non-refundable fees are legal in OK in this case, I also want to know if it is legal to not explicitly warn the buyer of this during the ticket buying process.??? Note that a ProTix representative told me there is no way to buy a ticket without these non-refundable fees, so it is not simply an option the buyer makes.

Here's another Yahoo answer that explains how laws put limits on what contract the seller can set up with a buyer. It is noncommittal though, since it says laws vary by state with respect to this specifc situation. But just for reference...
