Is my boss breaking the law?

Postby orson19 » Mon Dec 12, 2011 5:46 am

Okay here is my situation. I work on a farm in ontario, canada. I was employed a few months ago. My boss made arrangements for me to work for $10.25 an hour and she said there would be no taxes on my checks. I would normally work 12 Hrs a day and I was not allowed to leave my workplace until all my tasks were finished.

A few weeks ago my boss said that she was only going to pay me $70 a day, regardless how many hours I work. Now i'm still working 12 hrs and only receiving $70 a day (under the table). My boss has no insurance for me despite my job being very dangerous. My boss also only gives me a 1 hr break to eat lunch.

Is what my boss doing illegal? or is this acceptable because it is farm work. (the farm I work at offers horseback riding lessons and is considered a Business) I'm planning on quiting the job because i'm not being payed fairly.

I would just like to know some information about this and labor laws in canada.

In the UK, this would be illegal. Make sure you have another job before you quit.

Since it's under the table, it's not illegal. If you don't like being paid $70 per day, then quit.

You're complaining about a 1-hour lunch break? Really? That's more than acceptable!

What both you and your boss are doing is illegal, you could both be charged under taxation laws, your boss is capitalising on the fact that you know (and you do know) that what you are doing gives you no rights to any protection from any official authority.

Since it's under the table, it's legal that she pays you $70 a day. Depending how old you are, it is illegal that it's under the table. If you're not happy with it, then quit.

An hour is a long lunch break. Strop whining about that.

I am sure your territory has labor laws and you probably need to check any web site that would refer to those laws
