Is there a law in Florida (or in the US) that employers must pay their employees on time?

A friend of mine works at Einstein's Bagels. He was supposed to receive his paycheck on Tuesday, May 20. Today is the 22nd, and he still has not received his paycheck. Whenever he tries to discuss it with his boss, she comes up with some excuse why he hasn't gotten it yet. He contacted corporate, and apparently they keep coming up with excuses too.

To make matters worse, he took out a cash advance on his paycheck and told the cash advance people that he would pay it back when he received his check on the 20th. He is now being charged late fees because, obviously, he cannot pay if he hasn't received his check yet as he was promised.

Does anybody know if in Florida (or in the US), there is some sort of law that states that employers must pay their employees on time?

"Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment. If the regular payday for the last pay period an employee worked has passed and the employee has not been paid, contact the Department of Labor's Wage and Hour Division or the state labor department. DOL also has mechanisms in place for the recovery of back wages. " Though, this may or may not be your last check; but I would think twice about throwing away you valuable time at this job any longer. You certainly don't want to wiat months for "wage and Hour" to recover your paycheck.

This is a sure sign the store is in dire financial straits.

You're friend should cash the check immediately when he gets it, and start looking for another job.

No company would let payroll slip willingly - every other vendor will go without being paid before employees - because don't pay employees and you don't have them, then you can't open the store and make money to pay everyone else.

Trust me, I have been there on the company side on this.

No law can force them to pay "on time" if they don't have the cash to pay.

Your friend should tell his employer that he wants his check immediately and that he will report them to the department of labor for your state, if they fail to turn over the check. States do have laws that specify how often employers must pay their employees. Employers can be fined by the labor department for failing to pay their employees in accordance with those laws. Unfortunately, the practical problem is that the labor department will be slow to act.
