Is There A Statute Of Limitations On Debt Collection And Credit Reporting?

Postby Birkey » Thu Jan 16, 2014 8:01 am

25 years ago I was in a negative marriage and we ran up some poor debt. I virtually lived off the credit grid for 10 years, and given that have built up an more than 800 credit rating, purchased true estate and have carried out fairly properly. In the last year or so, a collection agency has been coming following me for one paticular debt. I believed there was some sort of statute of limitations. I am not asking you to inform me if I am morally obligated to spend this debt, I am asking if they can legally enforce it following all this time and if they can nonetheless report it to the credit bureaus.

10 years a collection agency can attempt and collect up to 10 years in California.  Nonetheless what they do is sale the claim to one more agency and it becomes new again. I'll bet dollars to donuts that they'll settle for a lot less than the original amount, if you want to deal with them. If you tell them not to call you on the phone, you pull their teeth. They're not going to sue you. Whoever you had the debt with initially wrote it off long ago.As to your credit report, I think they only go back 7 years, and only certain kinds of debt are reported. Statutes of limitations on debt vary from state to state, so I'd check with your state attorney general's office. 55 months ago

Realize that they are a business intending to get you to use their legal services, so take everything they advertise with a grain of salt. But I'm still curious - how did you "build up an over 800 credit rating" if you "lived off the grid for 10 years". Do you mean that you had massive debt 25 years ago, hid from the collectors for 10 years, and then after those 10 years, started fresh? And now suddenly they're calling you for the first time in 15 years? 55 months ago
