Is there any California law that requires a residential landlord to provide a safe and secure mailbox?

Postby roche » Wed Nov 30, 2011 10:05 am

My landlord refuses to move my mailbox or replace it with a secure one despite my requests. The kids from the Continuation school walk by my mailbox which is on the sidewalk. Needless to say those children who have had a inconsistent educational experience have been swiping my mail. If the mailbox was moved off the sidewalk and on to the property about 25' then I believe the problem would go away since those kids are too fat and lazy to go out of their way to f*ck with me. Do I have any legal standing as a residential tenant to demand a safe, secure, and accessible mailbox?

The landlord is only required to provide you with a mail receptacle. He/she is not required to provide one that locks or isn't accessible to the public. Stealing someones mail is a felony. If you feel you need a secure receptacle you will need to invest in one on your own, but where it is placed inside the property must be approved by the post office and if it is to be permanently affixed to the property (with any kind of hardware) you will need to to also get approval from your landlord.

The post office determines where your mailbox is to be located. You need to ask them if one closer to your house is acceptable. If the USPS agrees, then YOU can buy the mailbox you desire. The landlord does not have to provide ANY mailbox for you.
