Is there any legal recourse for my friend?

A friend of mine went to a doctor who perscribed a sulphur based perscription. My friend is allergic to sulphur and had a mild reaction that kept her out of work for a couple days. Her chart did indicate that she was allergic to this medecine, but this fact was overlooked by the doctor. Can she recover the lost wages from her doctor's malpractice insurance even though her claim will be relatively small? Would it even be worth it to file a claim?

If her chart indicated it then the doctor is at fault. Regardless if your friend sues or not, she needs to know that from here on out always....always check what the active ingredient is in any drug. As for filing a suite, the size of the claim may not be much, but it may teach the doctor to pay better attention. If the suite isn't worth it to her, she should at least confront the doctor about what he has done.

It would not be worth the amount of money it would cost, unless she is a CEO of Exxon. It would be Sulfa not sulfur. Her pharmacy should be aware of the allergy also. To file a Med Mal or Negligence claim there has to be permanent damage, use that as your guideline.

Oh my goodness. Your friend has never made a mild mistake in her job? So she wants to sue. Why? Because the doctor/insurance company has money.

The key is mild reaction. Why is our society so litigous?

I would file a claim and ask for lost wages and three times the amount for damages and mental distress. Dont let it go if they did it to her they will do it to others.
