Is this big enough to report for Libel Damage?

Postby stein74 » Thu Mar 31, 2011 5:45 am

I broke up with my ex because his ex has been saying stuff about him and spreading it around, she's done this before because she didnt want me and him to get together and now she's done it again and wants to report her, well he say's he's reported her, she's been saying he's 23 when he says he's 19, been cheating, sending txts to her and said he's such a liar etc, I know it doesnt sound much but he told me he's spoken to he's solicitors and she's getting a summons letter to go court. He say's he's telling the truth and i dont know who to believe he sounded really genuine but i dont know, ke keeps going on about il prove it to you and starts crying and being angry for me not believing him..what do you think?

Given the trivial accusations, the small possible compensation, and the huge costs of a libel case, it would be very unwise to sue for libel in the situation descrbed.

A court would probably rule that as everyone knows jilted lovers often make wild accusations against the ex-partners, sensible people who heard these claims would probably be doubtful about, and therefore little influenced by, them. Remember, to prove libel it must be shown that the claims would cause 'ordinary sensible people' to think less of the alleged victim.

No, she would get a warning letter from a lawyer but for the case to go to court a crime would have to be committed. In libel cases something has to be published and distributed to the general public. He can do nothing unless he has proof, maybe a nasty letter she wrote or texts. I don't think this woman has a case to answer although it is very nasty.

He must have deep pockets if he is trying to bring a libel case.

Unless he is "famous" then even if (big IF) he won he would get a minimal amount.

Has he got any money? taking someone to Court is not free. If he is unemployed then he is telling you porkies.
Does not sound enough for a court case.
