Is this legal for a college to do?

Ok so I received a check from my college for a grant (this college is in Florida) and I thought nothing of it just happy to receive some money. But now months done the road they say that they accidentally sent this money out and now want it back. Only problem is I don't have the money and no way of getting the money back to them. I was not the only student affected by this mistake. Should I threaten legal action and even a class action lawsuit?

Your threat to sue is meaningless. You might mean that if the college sues you then you will assert your defenses, but you have not been damages by the receipt of the check or by the efforts to get it back.

Whether you have a defense depends on much more than what you said here.

It cannot legally become a "gift" to you unless the person sending it intended it to be a gift to you and had the legal authority to give that property to you. Once they have delivered a proper gift, it becomes irrevocably yours forever. In this case, there are probably multiple reasons you may have to give it back and multiple reasons that you don't have to make it easy for them to get it back.

If the money is not yours - then you would be wasting your time. You would have to prove that the money is properly yours. I would suggest working with the college and try to work something out to repay from your grant once it is received - or other way to repay the money.

Technically if they gave you the money as a mistake, they have a right to ask you to give it back because it wasn't yours. This applies to any situation like that. If your bank makes a mistake and puts a million dollars in your account, you will have to give it back because it doesn't belong to you. You should see if they will let you make payments on the amount you now owe the college. If not, you may be forced to take a loan to cover the amount you owe. Good luck!
