Is underage consumption a Misdemeanor or Petty misdemeanor in Minnesota????

Postby hagaleah » Wed Mar 28, 2012 10:57 am

I am filling out a job application that asks:
“Have you served a sentence in jail or prison or been convicted of a crime for which a jail sentence could have been imposed? You may answer no if the conviction or criminal record has been annulled, expunged, sealed, set aside, or purged, or if you have been pardoned pursuant to law.”

About 8 years ago when I was 18 I got an underage consumption. I don’t recall much about it but for some reason I went to court instead of paying the fine. (It was my first underage I have had nothing else) I am guessing I didn’t realize that I didn’t need to go. The judge pronounced 5 days (meaning jail I’m guessing) and gave me a stay of one year (basically probation). I did 20hr community service and paid $27.00 and that was the end of it. What was this 5 day thing when you can just pay the ticket and never appear? I just called the fine line in my area and now the fine is up to almost $300.00 but you can just mail them a check and never appear. I just need to know if I should be checking yes in this box. Thanks for the help

Is underage consumption a Misdemeanor or Petty misdemeanor in Minnesota????

A petty misdemeanor is the legal designation in
Minnesota for a violation in which the sentence may
not exceed a fine of $300. A petty misdemeanor is
not a crime. No jail or workhouse time can be
imposed and/or stayed upon a plea of guilty or a
finding of guilty on a petty misdemeanor charge.

Currently - Underage Consumption or Purchase is
$100 to $700 Fine & Up to 90 Days in Jail.

However - you should not go by what the law says today, you should go by what the law was when you got the conviction.
