Job Termination After Resignation

Hi Umesh,

Thanks for being available for people like me.Recently I resigned from my company.I had to serve 2 months notice as per contract.I was unable to do same.So I called my manager that i can at most serve 20 days notice.

He said no and send me to Employee Relations.I tried to convince to HR that I am unable to serve notice but they did not agree.As per my employee agreement if i fail to serve notice I m suppose to pay 2 months salary which I agreed.This angered my manager and he said company has enough money it doesn't need your money.

Instead they decided to terminate my employment stating that I was inefficient to do my work.

They send me a letter asking me to accept termination and also rejected my resignation stating that I am absconding.

What are my options now and how badly this will affect my career.The organisation is very big.Will this affect my career prospects.Should I sen a mail to CEO as those involved are taking actions stating all wrong reasons.

I have all my mail conversation recorded and printed with me.It does not say inefficiency at work anywhere.

ANSWER: Dear Karan,

Hope you're doing fine.

There are three situations. One you send them a notice, file a civil suit after years of contest in court you win, you get the F n F amount and you feel you won. Second, you resign by giving proper notice period or negotiate on notice period, take your F n F and certificate and apply for another better job and feel happy looking ahead. Third, they terminate you, they pay your F n F, you leave but after 3-4 years one company where you're employed/or will be employed in future does your reference check and the past employer states as per its records "you were terminated". Which option you want to choose? Pls tell me.

Dear Umesh,

I have presently no choice as they have already terminated my employment stating me as absconding.

What are my options now.

How do I make sure my career prospects are not affected in a worst way.

This all have happened at earliest period and i never had a chance from the HR department to put my point of view they only followed lead from my manager.

Please advice what should be my next action.

Dear Karan,

I think you should request them to consider your resignation. Organisation always prefer to have resignation rather than issuing termination letters. I am sure they will accept your resignation. Speak to your reporting manager, HR Head and may be CEO also in case things don't go your way.
