I live in Texas.

I work at a movie theater. I'm labeled as a "Part Time" employee. Which basically means I shouldn't be working more than 40 hours a week. I've worked 100 hours in two weeks on two occassions, almost all my paychecks are more than 80 hours (we get paid bi-weekly). The hiring manager informed me that since the job is seasonal we aren't due time and a half. Even though I have worked here since may 31st, I am still labeled as part time. Am I due to get time and a half? Or are they justified in doing this?

Also, a few of my fellow employees have been promised leadership positions- lead runner usher, et cetera, and have been 'supervising'. Which is basically the same thing with less pay. I have been informed this is also illegal? Can anyone give me more information regarding that?

Finally, our regional manager was here the other day, and saw a few employees on their cellphones. She was angry the managers didn't reprimand us and is demanding that we ALL get written up. All of the low level, starting employees. I wasn't there the day she saw people using their phones. However she is writing up everyone so that we all see that we are 'equal'. Is this write up justified? Can I refuse to accept/sign the write up?

I'm pretty much asking if I'm due backpay for all the 'overtime' hours I've put in, if my coworkers are due compensation for the empty promises, and if the mass write up is justified.

Movie theater employees don't qualify for overtime pay at time and a half under federal law. Texas follows federal law. Look at the list of jobs exempt cited below. And there no law against writing you all up.

assuming you have no contract, no law governs "write ups" or other internal discipline. Your hiring manager lied about overtime and you are getting paid unlawfully. You are entitled to overtime for anything in excess of 40 hours in a week. As for paying people less, if they are willing, no law prohibits stupid contracts so long as they exceed the minimum wage.
