Landlord Attempting To Sue For Non Payment Of Book

Our landlord is attempting to prosecute me for non payment of rent. I paid the rent for May, 2006, but paid it late, and paid the late fees prior to the conditions of the Rental. The Rent makes no mention of any selection actions or fees, or something about match, nor any mention of any reasonable attorney's fees as-is what the law states within NJ. The landlord attempted to get this done in my experience a year ago, and dropped in court. Once The landlord attempted to get this done, it had been the same time as a year ago, that will be the same time as my renewal pops up. It seems that itis some kind of fraud to try and have more cash. I know I paid the rent late, but I paid it late and abided by the late charges within the rental. The landlord accepted the lease, but explained I still needed to pay the court charges for processing (which she submitted the problem 2 times before I settled). The landlord dropped in court last year and will drop again-this year, actually the judge last year blasted the landlord and lawyer for having such an invalid, illegal rent in NJ. The areas are privately-owned, but I actually do realize that they take Sec. 8 deals and there are people living there on survival, therefore Iam unsure what regulations affect me. I actually do not get help. This month's rent was paid promptly and this past Friday I acquired my check back under my appropriate. Doorway with an email to please spend overdue charges. So today, I am getting this month's rent to judge on 06/23 to cover it once the reading for the function last month is planned for.Any guidance?

Question just what did thejudge blast the LL in lease as being illegal? That may be a big hint on what to remember to bring up again!

The judge blasted the attorney and the director (agent) as the type rent they use is old and obsolete and illegitimate since it doesn't specify "reasonable attorney fees" according to NJ regulation, nor does it specify a period whenever a selection for non payment could be introduced. The lease states the rent must certanly be paid by the 7th, if following the 7th a 25 late fee is applied (rent + 25 extra); if not paid by the 15th, a 50 late fee is applied (rent + 50 extra); if the rent is paid to the last day of the month, it is an extra 75 (rent +75). The rent doesn't note any action for collection of non payment or a period of time where a collection action may take place. Usually, within this condition, an assortment against an individual may only be introduced if a product or issue is 30+ times or older. Additionally, the landlord doesn't continue the lease having a new lease only at that location according to NJ regulation. They simply give a one linen restoration that is kind of as an addendum including the rent increase. Another thing this place does it mandate which you purchase the share at 50 per individual in each house (my apt. is 2 bdrm for me and my boy and heis only 5 and I still need certainly to pay 50 for him - and I actually needed to pay 50 for him three years ago when he was just rarely 2). The areas can also be privately-owned so the landlord isn't an "inc." or any "LLC" or something so I am not actually certain which NJ regulations affect me. All I do know is that a year ago, they dropped, and whenever a lease renews in this location, theyare usually using their fingers out!I know exactly what the next guidance will be... "move" =) It Is hard like a single-parent, but I'll probably attempt to move despite the fact that Kindergarten is beginning in the fall (my lease is up mid-sept which smells)
