Landlord Privileges?

Postby regenweald » Tue Jan 21, 2014 9:14 am

I'm a landlord of the top end property. The residence was hired via a property agent and the tenant ended up to be always a grifter. We're along the way of foreclosure with this attorney. We're in NY. This tenant appears to move from home to home until he gets evicted. I googled his name and discovered he's had atleast 2 conclusions because of foreclosure. My question is what legal recourse if any do I've after he's evicted-1.) could I get after the agents? 2.) May I have this guy charged with fraud? It seems this tenant doesn't have income and is proclaiming bankruptsy. I know I may take him to small-claims court but little good that will do me.

Landlord Rights?

I would be tremendously amazed if anyone signed an arrangement that retains the representative safe from inexperienced testing, fine print or no fine print. That is just what the brokers are taken care of! Worse, such a waiver virtually encourages them to camp "squatters with advantages", such as their very own relatives in monetary distress.

You're accountable for the incompetency of one's broker! You selected the agent.Somebody appeared to have didn't do fundamental history and credit and report inspections! Today when the agent developed to complete screening you may have an incident regarding inexperienced screening--but I will guess the fine-print efficiently has you keeping the agent safe whilst the agent wrote the agreement and lined own tail. For now you need certainly to concentrate upon obtaining the guy OUT and ensuring he doesn't utilize bankruptcy to obtain more free squat period

Landlord Rights?

It had been another broker who introduced this tenant. This broker was accountable for carrying out a credit check and 2 conclusions must have turned up. Should not she he kept responsible? I understand I've no possibility of recovering anything. I truly wish to criminally charge him. Only seems insane the regulation enables others to become used. Might any charges remain? Scam? Ideally the judge may honor us a money thinking tomorrow at court. I do not understand how a lot more nights of free lease he'll provide. He currently got one adjournment.

Best to keep the issues to one post.We cannot know what your contract with this broker says or what the broker was obligated to do for you to say whether you have a good breach of contract case.
