Legal question for FCRA/FCCA and debtor?

Postby tredway » Thu Mar 31, 2011 4:32 pm

NMAC is the supposed debtor:
illegal Unverified Amounts under dispute in Credit Report, that NMAC is Reporting As Charged Off, on a Fully Paid off Car Lease
NMAC has and continues to report incorrect damaging information to my (3) credit bureaus (Transunion, Experian, Equifax) on unverified under dispute and Illegal Amount of $7705.00 Balance on my FULLY Terminated and Paid off Nissan Car Lease Account. NMAC is reporting this amount as a Charge off, when it is in reality an End of Lease charges that are under review/dispute for validity. This is an Illegal practice designed to damage my credit standing and has NO merit for reporting this as such. I have legally disputed this amount via written means and NMAC continues to ignore NC State Consumer Law and Federal Consumer Law by Violating my
Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. § 1692 et seq., and The Fair Credit Reporting Act (FCRA) Federal law (codified at 15 U.S.C. § 1681 by reporting and misclassifying $7705.69 amount under dispute as a Charge off, thereby causing severe damage to my credit score and standing.

your first step is to notify the creditor and if they fail to address the issue then you file a complaint with the FTC....

this link explains what steps you MUST take, read it and follow the directions.
