May Academics Talk Poorly In Regards To A Pupil

Postby Struthers » Wed May 14, 2014 3:49 pm

Our issue requires defamation within the state-of: An instructor at my old-school spoke to my closest friend/ ex-friends parents about me. She stated items that were accurate and items that were not. My entire life was tough and so I had completed poor points, therefore she informed them about how poor of the child I'm and did not mention something by what triggered it. I'm prohibited to keep in touch with my buddy anymore due to the issues this instructor explained. Is there a regulation declaring that the trainer can't talk poorly in regards to a pupil to a different pupil/parents?
Any responses could be extremely valued...
Thanks!

Can Teachers Speak Badly About A Student

Postby Strahan » Thu May 15, 2014 2:40 am

Quoting Studentneedsadvice

Is there a law stating that a teacher cannot speak badly about a student to another student/parents?

Any replies would be highly appreciated...

Thank you!

Yes, there is law, as the forum topic denotes, defamation.

HOWEVER, idle rumors or such non invasive gossip that does NOT rise to the level of defamation, well, is not.

Being talked about, as you will find throughout your life, is a way of life for some people. Unless the talk was so clearly defamatory, no resonable person could conclude otherwise, you have no legal remedy.

Can Teachers Speak Badly About A Student

How can there not be? I mean it is wrong for a teacher to go around telling parents that a student is a bad kid and telling them why they are a bad kid. The things she told them were only told to the teacher because i was missing school for hospital visits. That seems like confidential things, and shouldn't be told by a Language Arts teacher but by the principle or someone with higher status.

Because there isn't.

This really isn't so hard to grasp, is it? No, there is no law prohibiting teachers from speaking ill of their students, any more than there is a law prohibiting students from speaking ill of their teachers.

If you do bad things, you can expect people to talk about them or otherwise make them known. It doesn't matter WHY you did them. If people talk about things you DIDN'T do, AND you can prove that you've got quantifiable damages, you could consider a defamation suit. If you're a minor, and your parents have determined that, for whatever reason true or not, that they don't want you talking to a certain person, that's the decision of your parents and not actionable in court.
