16 years ago my son and I were awarded a nice settlement (mainly my son due to his injuries) from a medical malpractice lawsuit. If I recall correctly I was told that I could never speak of our settlement and the doctor, ect. Several years back I tried to get documentation of our cases from the Wy courts and was told that our attorneys had to request them. I wanted these records so I could sue my sons father for half of the expenses that our estates paid towards medical bill of my sons birth. Well I never followed through.
7 years ago my son went to live with his father, non disputed with me and we were to share joint custody. We are now in litigation for custody and financial reimbursement for medical ect. Well I received a subpoena and not through my attorney requesting mine and my settlement and monetary gain. Granted I can call the attorneys on Monday and figure this out, however, I go to court on Wed and was just hoping for a few answers.
What options do I have if I can not get these records? Since my sons father has requested these documents to be produced in court, now can I drop the bomb of estate reimbursement.
The medical malpractice suit is in Wy and custody litigation is in Co.
One last thing, am I correct by thinking that if my sons fathers requesting these settlement documents to be produced, the attorney himself has to subpoena these himself and not go through me? Mind you, my sons father was not nor was ever involved in the malpractice lawsuit.
