Medical malpractice? I was wrongfully diagnosed with cancer?

Postby forde » Tue Apr 24, 2012 4:48 am

Went through with treatments and now my blood is very messed up from radiation. Went to two different hospitals only to find out I DONT have cancer... Can I sue? How should I go about this? And how much do you think I'd get out of it? Treatments were very expensive.

im not sure what you mean by "my blood is very messed up"

but ultimately not everything is a medical malpractice case. if the doctors truly believed that you did have cancer then they treated you as a cancer patient. if you wanted a second opinion or did not trust their diagnosis you should have gone to another hospital/doctor.... but youd have to prove that they diagnosed you wrongfully and KNEW they did so and followed through with the wrong treatment anyway its a tough case to prove

The question is not how "messed up" you think you are, or how expensive treatments were 9did YOU pay or did insurance, if insurance did, YOU can't recover that money).

The SOLE question is would a reasonable medical practitioner in that comunity have made the same diagnosis.

If there was no malpratice, there is no laawsuit.

Did the doctor's have test results that showed you had cancer? If they did then they treated you based on the information they had. That's not malpractice.
