Medical malpractice statute of limitations?

Postby orlondo100 » Thu May 10, 2012 10:03 am

ok, I had a "sensitive" operation back in April on 2009. I had major problems with pain caused by the operation and was diagnosed with Vulvadynia in June of 2011. I now still cannot have intercourse because it is intense pain and cannot conceive a child without the help of artificial insemination. Mentally, I suffer from chronic depression and am in intense therapy for the trauma this has caused. I know the statute of limitations for medical malpractice is two years, but I have heard that starts from the time of diagnosis. Does this mean from when I was diagnosed in 2011? If that is the case, can I still sue for malpractice?

Also, immediately after the surgery, my gynecologist went out into the waiting room to find my boyfriend (now husband) and showed him pictures of my va-jay-jay on his iphone. I would imagine this was some kind of Hipaa violation? Anyone know if I have a case here?
