i had my son in dec, 2011  and i wasnt told that he has melyomengical untill a week before he was born, now remind you i was so sick i couldnt work for 2 months and i kept telling my doc that soemthing wasnt rigth and he kept telling me that everything was fine, didnt do any tests at all. he told me at 10 weeks my sons spine wsa formed just fine.  now i switched docs due to him not running any tests, so is it possible for me to sue him for not noticing my sons conditon?

"He told me at 10 weeks my son's spine was formed just fine".  What this at the FIRST ten weeks of the pregnancy or was it at the LAST 10 weeks.  I am just guessing but I bet that spina bifida probably can't be seen at 10 weeks by ultrasound or probably doesn't even exist at that early stage. If I am right about that, then what he told you was correct.......at the time.  Again, I don't have expertise in this particular medical issue but I would also guess that your being sick had nothing to do with the spinal bifida problem.The legal question is, how often should an ultrasound be done based on your medical/pregnancy history and should the defect have been noted????  But let's say the problem should have been discovered by the 6 month mark.  What could be done?  Probably the only option would be an abortion.  Would you have done that?  Sorry I can't be of more help. Suggest you contact a large medical malpractice lawfirm in a nearby big city.  Call and tell them you have a serious birth defect case.  That will get you in the door. Good luck.
