Michigan 3 Strike Law

Postby Codi » Sun Jun 15, 2014 12:30 am

is there a statute of limitations on how far back they can go to add "habitual offender" to any current charges?

IE: a felony conviction from 1985, used to add habitual offender to any charges that may be brought forth now?

Jim,

There is no limit on how far back they can go.  All that is required is that it is a felony conviction and can be in any state or federal court. The defense argument would be one of constitutional validity of the prior conviction.  MCL 769.10 thru 13

Good luck
