I think the state is correct in this instance. States have developed laws of this nature to protect children because there have been many instances in the past of children being injured n non-licensed facilities. I think if she really wants to watch kids, she should comply with the laws, which include a certan level of training, a background check, licensing and keeping books so taxes can get paid. Just because people break the law "all the time" does not mean that they should not be punished when they are dicovered. I mean, seriusly, what if her husband or brother was a child molestor?
