Mortgaged house in UK, joint ownership after split?

Me and my ex own a house together which after the split he has resided in to date. At the time of the split I did enquire with the mortgage lender to get my name taken off the house, unfortuneatly this wasnt cheap to do so I ended up leaving it, and to be honest I have forgotten all about it.
We have a daughter together, and of late he has pleading poverty to try and get out of paying his maintenance (he is self employed), he now owes 4 months payments. When i asked for this money to be paid he has stated he is on the verge of bankruptcy. Whilst I dont believe this is true, it does have serious implications for myself if it is, given I am jointly responsible for the house in the eyes of the law even though I havnt had anything to do with it for years. I am pondering going to a solicitor, but if its really expensive its not an option. Would it be worth taking him to small claims court for the maintenance payments and would the lender in a bankruptcy case take into account I have not lived there for 3 years? Thanks in advance for any information.

Well your laziness has landed you in trouble. You are still liable for the mortgage even if you have not lived there for years. If he is behind with the mortgage payments the Lenders will come after you. Which is more important, your backdated maintenance or months of you paying the arrears of mortgage.

Citizens Advice Bureau (check your library or yellow pages to find your nearest one. There is no charge for using this .
