Mortggage Refinance

Postby Meldon » Tue May 27, 2014 12:15 am

Hi there...my husband and I recently refinanced our mortgage with a closing date of November 22, 2007.  The mortgage lender has just noticed that the deed that is registered to my husband and I has my husband's first name misspelled(Jeffery instead of Jeffrey).  This has been missed since we purchased the property in 2001.  i am wondering what kind of impact this will have on our mortgage closing?  Is there paperwork to fill out to have the deed corrected?  Thanks in advance!

ANSWER: Hi Theresa,

Which city are you located in?

The best thing to do is to contact a land title office in your area. They would be able to determine whether it was the law firm or them who made the mistake. If it was your law firm's fault, your law firm would then have to file a request.

I hope it helps.

Regards,

Susan Gozali

Hi Susan, thank you for your response.  We live in Ottawa, Ontario Canada.  I was just wondering if the paperwork has to be filled out could it potentially delay the mortgage closing?

Hi Theresa,

I would suggest you to contact the land title office in your city and to discuss this with your lawyer. I'm sorry but I'm not really familiar with property deed laws in Ontario. What did you lender say about this?

Take care,

Susan
