I recently had my motorcycle towed from my own apartment complex because they claimed that it was parked illegally. Here's the details;
It was parked at the end of a parking row where the white striped lines are. NOT IN a handicapped space or in striped red or blue lines. They are WHITE.
I was parked inside the lines and not obstructing any walkways or other parking spaces.
I never received any ticket or warning. I've been parking there for several months and I woke up one day to go to work and my bike was gone.
Here's where I think there may be an advantage; I've been riding motorcycles for almost 10 years now. When I was in college and worked, I was ALWAYS allowed to park in the zones with the white/yellow stripes. And this follows for pretty much anywhere (work, school, shopping malls, etc). I have never received a warning or ticket for parking anywhere in the white/yellow striped zone next to a parking row. I did a walk through of the complex and there are plenty of similar spaces that DO NOT have signs informing people that this is an illegal parking zone. ON top of that, after complaining to the apartment office, I requested a copy of my lease and there IS NOTHING IN THE CONTRACT that states white striped spaces are off limits to motorcycles or bicycles. The best thing they could come up with was "It's just common sense and you should have asked us anyways if it was ok to park there." I can understand if a car were parked there, but let's be real. To my understanding, it was legal and in the clear. It was not obstructing any pathways or other parking spots. And most importantly, there was no sign or notification. Given the circumstances, I would assume that my bike was towed illegally against my own consent and without breaking any laws. What I want to know is, what are my legal rights? What should I do? What are the pros and cons of this situation? Are there any do's and dont's? As of right now, all I have done is research and talk to the main office. I am going to inform the property manager ASAP and depending on how that situation goes, maybe even legal action. I live outside the Denver area of Colorado. Any advice is greatly appreciated.
