Must I not benefit from both insurance policies my company is enrolled on?

Postby delron72 » Sun Jul 22, 2012 11:46 pm

my left radius is plated and i had to go through a couple surgeries to get that done. my company is enrolled on two insurance policies. the first plan (group personal insurance) covers all employees irrespective of where an accident may occur and the 2nd (qualifying one for workman's compensation) relating directly to occupational accident. i was on a local pay roll when i fractured my arm which has left me incapacitated to some degree across the border into a near-by country. i was just told 22 months after the accident that my country's labour policy have changed a year ago and does not permit a person to benefit from two plans with the same injury. And therefore no workman's compensation for me except the group personal insurance plan. Am i not being ripped off?

You're not being ripped off. By law you're not allowed to benefit from injury compensation.

Check your state's workers compensation laws. You might want to post your state for more help.

Not necessarily!

Just because your COMPANY has more than one plan, doesn't mean that YOU are covered!

When it comes to workers comp, the law is pretty specific in every state - you cannot "double dip". You cannot be paid twice, once from the health, once from workers comp. Workers compensation is ALWAYS primary. Even if you have, for example, a disability policy that does NOT exclude workers comp claims (highly unlikely), disability recovers the full workers comp amount, and you only get the HIGHER payment, not both.
