My cousin had his car at a body shop they broke it and won't fix it?

Postby barraq » Thu Jul 26, 2012 6:49 pm

My cousin has a breathalyzer in his car. And when he took it to get a dent taken out the body shop caused it to lock up the car and now it won't start. When he dropped it off he clearly explained how to use it and even wrote instructions for them. He can only have the machine serviced by the same people he bought it from, that was written in a contract or something, the place to get the machine fixed is 35 miles from the body shop and having the car towed that far is expensive.

The point is shouldn't the body shop pay for the tow? They were the ones that caused the problem after all, although they are refusing to pay for it, is there any way to make they? I know there are some laws dictating the responsibilities of auto repair facilities does one apply here?
Thanks for your help!

Take them to court, they are supposed to be professionals.

Your cousin was the one that broke the law, and was convicted of DUI. He could have contacted the company that installed the interlock, and had them temporarily remove it or disable it (and have someone else drive the car to the shop.

The shop was hired to do body repair. They are not in the business of dealing with aftermarket interlock systems, and are not liable for the problems caused by the system.

Your cousin will have to pay the tow bill, or find some way to get the car to the shop that installed the interlock

Sorry

Gee that blows, get it? blows, wow has a mandatory Breathalyzer and still has it at a body shop, you would think not drinking and driving would have solved that problem, but to answer your question its not there problem, it malfunctioned or the guy that tried to start had a few beers for lunch, it really doesn't matter, you could try small claims court, but I doubt you'll win,
