My employer deducted a girls pay for screwing up a wic check, can they?

Postby adare » Sun Apr 10, 2011 6:45 am

Okay so i work at a grocery store in Pa and my employer deducted money out of a girls pay because she screwed up a customers WIC check. I swear they can't do that. They also threatened me that they would deduct money from chickens being left in a oven all night and going bad. Is this okay for them to do that? I looked up some labor laws but i didnt find anything specific enough about Pa to convince me completely... If this is the case I will have to say something. People need their entire paychecks if the incident was just negligent not grossly negligent! Thanks

It is a violation of state and federal labor law and could also constitute a criminal offense in Pennsylvania. You have an argument to collect unemployment from them should you voluntarily quit based on an ethical objection to their pay practices and the illegal threats they have made against you.

Contact the district attorney's office for your county, contact the attorney general's office, contact the Pennsylvania Department of Labor, or file a private criminal complaint against the corporation or business you work for should they withhold money from your pay check.

No.my father worked for labor and industry for Washington state.your employer may not deduct money from "this girls paycheck" for any reason.that is illegal. it was an unintentional mistake that your employer is liable for through the department of social and human services.(welfare) the federal laws are uniform to every state.about the chickens left in the oven, your employer may take action up to and including termination.

Legally It takes a court order to deduct. Any thing from your pay. against Federal law to do so. They would need to prove negligence to do it. On your part. Leaving the chickens in all night they might do. But not a honest mistake on a check.

I had a similar situation in Florida and in Florida they can not and probably not in PA either but I am not a lawyer. You can ask a lawyer for free at www.lawguru.com when you post this question post it like it already happened to you and you want to take legal action. Go to the labor board in your town. If you can not afford an attorney contact the state board for attorneys in your state and ask for a lawyer on a sliding scale and they will help you. I say when you go to www.lawguru.com and post like it happened is because the lawyers respond better when they think they will get a client out of it. Get buisness out of it.
