I got injured last August, recieved 1 paycheck a week later, then haven't recieved a nickel since.
I havent recieved any medical treatment, just exams. I originally had a possible torn meniscus and was looking at 8 weeks of rehabilitation. For some reason my Employer turned my claim into the "Ohio BWC", after i signed the application for the BWC and submitted the paperwork my employer gave me, my Employer turned around and appealed my claim into the BWC....
I was contracted in Indiana, and got injured in Indiana, my employer is from Pennsylvania, but even promised my lawyer that I would recieve medical treatment and WC through the BWC.
So I've been turning in all the paperwork they ask and even went to their "certified" physician and the physician even said that i need minimal 6 weeks of rehab and surgery if nothing heals. (it was a right knee dislocation, i got xrays and mri's done).
Finally the day comes that my claim and my employers appeal are to be reviewed by the Ohio's industrial commision. I turned in all my doctors exams, paperwork, ect.. and then the next day my claim got DENIED, saying "There is not enough connection between the employees injury, and the Ohio BWC, the injury and contract of employment both occurred in Indiana"
WELL I COULD HAVE TOLD YOU THAT!!!!
but why in the heck would my employer have wasted all of my time setting up my claim in Ohio then appealling it, instead of just putting my claim through Indianas WCB???
When I tried filing for Indianas WCB my employer was saying that they had jurisdiction over my claim, therefore I had to sign with the Ohio BWC or I would lose my medical treatment and workers compensation.
What are they trying to do to me?! This sounds so Illegal but everytime i try to get an attorney from columbus to represent my case, they tell me to not bother! It's very rude and ticks me off like no other
I am going on 7 months with NO PAYMENT! i've had to loan all the money from my friends, family, whoever!!
My indiana attorney is setting up a court date that might be here in september... Isnt there anything I can do to expedite my court hearing because of all this crap my employer has put me through??
