Nco Filed A Lawsuit Against Me

Postby Gordain » Sat Jun 28, 2014 12:15 am

NCO,assignee of Sherman c/o Jorge M Pereira, Esquire, filed a lawsuit at my District Court for a credit card amount that is now $1928.34 plus intrest accruing at 6% as of 3-17-06. From the acct. number on the form, according to an credit report from Experian, the acct was 30 days del. in May 2001, charged off Oct. 2001 and Nov.2001, and purchased by another lender. It was originally with Providian. I live in PA. This is because I went through a divorce. What do I need to fight this?

Nco Filed A Lawsuit Against Me

Postby Eward » Mon Jul 07, 2014 5:28 am

Hello Jorene,

Now my blood is boiling!  I have dealt with NCO Group over and over and I am getting tired of their games.

I am going to gut to the chase on this.

Providian was a scam.  Providian had their portfolios collected by outside agencies.  Because there is no Providian, there is a HIGH chance that there is no backup in the file, meaning MEDIA.

So, here is what I would do if I were you.

If you have been served with a summons and complaint, answer by the deadline.

File everything as unknown or unable to tell.

Dispute the entire debt.

Demand that this attorney Jorge M. Pereira, provide you with the following:

1.  A certified copy of the ORIGINAL ACCOUNT APPLICATION WITH YOUR SIGNATURE

2. A Copy of each and every charge slip with your signature

3. Each and every statement from the open date of the account.

4. Copies of the front and back of all of the checks that they received from you.

Under the FDCPA, you are entitled to this.  If you want to see a current case that I am working on in Honolulu, Hawaii, just visit www.mywesterncapital.com and look at the Kevin Kim vs UNIFUND case.  This is almost like yours.

Do not ever NOT SHOWUP!  Just do as I say and this should be easy for you!
