No Show Defendant?

Postby Finin » Sun Feb 02, 2014 8:29 am

What is supposed to happen in the event that the defendant does not even show up for a visitation/child support modification? Do the proposed changes just automatically get granted to the custodial parent? Are there legal consequences for the defendant for not attending the court date? Thanks.

The judge can either postpone the hearing or he could very well grant the order without the NCP having any say in the matter. Hope for getting a judge that is feedup with deadbeat dads and he might just throw the book at him. Good Luck

If you asked for a particular kind of reduction - an order stating A, B, C and N - then you might request the court for a default view and to enter such order. In truth, surfaces prefer to choose issues about the merits, therefore if the N does anything in the event quickly, the court may possibly notice his/her side.

Generally, the court will hear what you are requesting, if it is in the child's best interests, grant it without prejudice to the NCP who can always refile.
