Option Against Organization Using Stolen Confidential Information

Postby Byrn » Mon Jun 30, 2014 2:01 pm

Our issue entails company regulation within the state-of: California
A former worker required my firm's customer checklist to some new boss and that I have established that she's obtained customers from my enterprise to her new boss in breach of her work contract. I understand I've legitimate recourse against her, and intend to follow that method. Is there any option from the new company who's taking advantage of private info taken from my company? Once that organization is advised of the problem, are they required to consider any healing steps? I've created a notice towards the new company requesting a summary of this former worker's customers in the fresh company to ensure that I will evaluate the titles to my customer checklist and decide the degree of the issue. Obviously this may be required in case, but I am dreaming about a friendly quality when they work. But what real option can there be when they do not work?

Do you have any evidence that they're aware that the employee stole your client list, or that they are aware that she's contacting people on that list on their behalf?

That you don't actually need much proof, that's what breakthrough is for in a civil case. You need to do need to have enough details within the criticism to endure a movement to ignore. Did she simply by opportunity obtain a work there, or was she poached. Claims from customers which have been poached is a great initial start.
You ought to have a lawyer create the brand new organization. Calling them straight isn't a genuine great concept to get a number of factors, but when you've previously completed thus, not really a significant problem. When you create the organization conscious of the conduct, of course if they dismiss you or proceed it, you then'd possess a very good situation for malice, wanton conduct which may help a state for emotional damages.
You'd require a lawyer to follow something this complex. Additionally, should you had a work arrangement, low-disclosure, etc. using the former worker that will create the situation definitely better and supply an activity for violation of deal, etc. Normally you've weaker matters under common-law, trade-secret law as well as the like.
I'd reckon that the reaction is likely to be an opposition to supplying what "they" contemplate their industry secrets.

Postby Ware » Thu Jul 10, 2014 9:57 pm

Just the notice I'll be delivering by registered email on Friday telling them of those details. I am aware that my option is spelled out in my own work contract, and also the economic obligation is hers. What I'm seeking of her company is just a list of customers she's offered since joining their company to ensure that I will evaluate my problems, evaluating her present customers there with my very own customer record. I've established two. I am dreaming about friendly assistance from her present company, but I'm attempting to cover-all my angles since that clearly might not be future. Is it possible to provide any guidance for this case?
