PA Labor laws can my boss do this?

Postby jomei69 » Fri Apr 08, 2011 3:45 am

I live in Pennsylvania and my boss put up a notice at work that says if we call out once within a year we get written up, if we call out twice within the year, we will be fired. Is this legal? I know that I can't always get in to the Dr. right away or I have a cold I'm not going to go to the Dr. because she can't do anything, plus I have no insurance so I don't need the bill. Also, if we don't give two weeks notice she changes our pay rate to minium wage, is this legal? Can she do this. I work in an assited living facality, if this helps.

Yes, all of that is legal. An employer can require you to get a doctor's note simply for one absence. An employer can fire you for this on your first offense. If you are too sick to go to work then you are sick enough that you need to go to the doctor.

An employer has the right to set the wage a person earns as long as it is at least minimum wage. The only way any of this is not legal is if it is not included in your company policy and there is nothing in your policy handbook that says the policies can change, or you have a contract with your employer that has everything spelled out between you and the employer.
