every 2 weeks I get paid. My pay stub is online and is always incorrect. When I call my pay roll department they tell me that the pay period stated on the check is wrong. They also tell me the vacation, sick, and comp time shone is wrong and that to get the real totals I should call them. Is this legal? My co-workers(approx. 500) are in the same boat. Thanx

ANSWER: If they are dealing with payrolls ending on different times it is quite common for the pay date to be incorrect. The totals for sick, vacation and comp time are not always right , especially since most companies cut off a week ahead of processing. This would mean that the week before processing would not show on the check for any used or accrued time. Because of this I do not print it on my check stubs. I have both salaried and hourly employees so the pay date for hourly is the friday before payday and the paydate for salaried is the same as the friday check date. I can only use one paydate in my system so my paydate and check date are the same, but it is not correct for the hourly.

If the amount in hours and wages is correct on your statement it should be fine as that is what matters. All you need at the end of the year is the W-2 which will have the correct information. if your hours and amounts are wrong than you should make them correct the error and if they do not put in a claim with the Department of Labor for incorrect wages. If the horus paid and the amount paid is fine your wages are correct the rest does not matter as long as it is correct in the computer system.

The dates say specifically "Pay Begin Date" & "Pay End Date". The "Advice Date" is always a week after the "Pay End Date"(the date I am paid). As far as the sick, vacation, and comp time the can be hundreds of hours off, not the recently accrued not tallied. It seems the only thing I can trust is my name and address. As far as your answer of:  If the amount in hours and wages is correct on your statement it should be fine as that is what matters. that is so wrong because my vacation, sick, and comp time IS money owed to me. How am I supposed to track them if I do not have access to their computer system? I am supposed to believe them when they can't even use the system to give me a correct pay stub which is generated at some point from their system.

ANSWER: You will have to take that up with the company. The only thing that is required by most states on the pay stub is the name, address, hours worked, pay rate, and total pay. Vacation, sickpay, PTO, all of those accrued times are fringe benefits paid to you by the employer. They are not required to be given by law. Some states have laws that if they are accrued than they must be given to you or paid. Some states do not address this issue. Most states say the company policy must be followed. The employer in all states can say when they can or cannot be used and they do not have to be paid out if you terminate unless you have it in writing somewhere that they will be paid upon termination.  They do not have to show on the pay stub.

Some states do not even require pay stubs.

This is what is required on the pay statement in MA:

Pay Slip, Check Stub, or Envelope showing :

Employers and Employee's name

pay date, hours worked, hourly rate,

nature and amount of deductions or increases.

M.G.L. ch. 149 Statute $$27c.148.
