Hi. I am a paralegal at a small law firm in Madison, Wisconsin.  I started over a year and a half ago.  Upon being hired I was told that I would have a performance/salary review after 6 months.  I did, and received a raise($25K to $35K).  I was told again that the next review would be a year.  That year was up in October.  I reminded the office manager(who is the wife of the attorney) in September, but due to reasons beyond my control, the review has not happenned.  (The lawyer had briefs due, they were on vacation, last minute meetings with their lawyers, etc.).

Do I have a right to demand a retroactive raise for the raise I should have recieved in OCtober?

Hello Patrick,

There is no federal law I have ever heard of that gives you a right to demand a retroactive raise.  I think as a matter of equity it would be proper for you to politely point out the delay in adjusting your pay and mention the delay was none of your doing.  Before I said or did anything I would ask for the review and see what they do.  They may recognize the problem on their own and correct it.  if they do not I would then ask.  I believe it may be worth your while to look into the labor laws in Wisconsin to see if they can help you.  Gooooooo!!!
