Police illegally ordered my car towed. how can I get compensation?

Postby syvwkh » Sat May 19, 2012 6:22 am

I was visiting a friend in biscayne park FL. my car was reported as a suspicious vehicle and for whatever reason, the police apparently incurred the desire to remove it. it was legally parked behind two other cars, thus they reported that it was an abandoned vehicle despite that it was in perfectly operable condition current plates, registration, etc.; when i first found that my car was gone i called the police via 911 and they hadnt actually been informed of the tow, sent the local officers who had actually ordered it. i asked about which laws i had violated, then how my car qualified as an abandoned vehicle, and so on; they provided no direct responses and were patronizing.
i was/am in the process of moving so everything i owned was in the car; they scavenged through it and found my lisence in the glove compartment, where there was also approximately $100 cash in a little bag, thoough they reported that nothing of value was in my car (there were multiple obvious items such as a gps on the drivers seat that were); when i found my car in the junkyard the glove compartment was open, the money was gone as was my registration, and the bag which held the rest of my cash was on the drivers seat, open, and all of the money was gone from it as well (that bag was previously far back among my rubbish) ; i finally found my registration on the ground several feet behind my vehicle. the utility charger was also broken, as was my back bumper, I missed freelance work i would have done in town and instead of continuing my move had to go 1000 miles back to the last place i was, bcause i no longer had the money to rent anywhere. Ive called chief' of the department who told me all he could do was provide a copy of the report as i continued to ask him if he coudl not enforce that his officers were following protocal, etc, consumers affairs, the DA's office, DMV, and MANY more lines. at first, I would have backed off on a simple direct refund of the towing fee, but I am so angry and frustrated that I am inclined to pursue a larger portion of all the monetary offenses, but I cannnot seem to find an appropriate lawyers office or anything. who can I contact about this , legal, goverment, or otherwise? at this point I refuse to let it slide, as many have advised me to do.

File a claim in small court.
Back up everything with paperwork.

You can find a list of the biscayne Park ordinances and resolutions here: http://www.biscayneparkfl.gov/index.asp?Type=B_BASIC&SEC={9A5E52D2-224E-41DB-9773-701FA2839899}

Compare the ordinance number to the citation that you received from the police. that will tell you why your car was towed.

Your description sounds like you left a car full of garbage parked on the village street - probably for quite some time? Biscayne Park is not the sort of place to park rolling junk on the streets.
