I'd prefer to Appreciate everyone that has responded.  I'm along the way today for searching for a lawyer.  I actually do have yet another problem though.  I'd prefer to buy my very own house but can't because he's all my cash. If he makes 6-figures, has significantly more than double the cash he owes me in resources and in his 401K can not a judge make him pay me.  He's 60 yrs old therefore would not he have the ability to remove it of his 401k with no fee?
