Proof Of Service: No Address Information

Postby siuaghan » Wed Jul 02, 2014 12:20 am

I am in California.  And recently my ex husband moved out of state with our children(without my consent) and I have family law documents that need to be served regarding mediation and court dates for our case.  However, I don't know where he is exactly.  I know he moved to Kansas but that is the extent of it.  When he was served the filed docs to his last known address here in California he didn't get in time or else didn't get them at all.

Please help!

Thanks!!!

Angela,  Unfortunately you will need to have him served. I would also check your custody orders, because *most* states now require going back to court to have orders changed before moving out of a county, let alone the state. If you have court ordered visitation, he is in contempt by moving out of state and not letting you see your kids. Unfortunately there's nothing you can do without getting him served. If you have custody orders and he's fled the state, you can try filing a motion in court, and possibly see about having a warrant put out for custodial interference. If nothing else, I would try to file a contempt motion, but again, depending on your court, they may not do anything unless you can get him served. Your options are that you can hire a private investigator. Or you can try some of the online people search sites. That will be cheaper, but I've never used them, so I can't recommend any in particular. I would suggest trying to call his family, see if anyone knows where he is. Sorry I couldn't be more help. Good luck to you, and if you have other questions, feel free to post a followup. God bless!
