I am entitled to property in goa(belonging to the entire family & which is being disputed in court- with reagrds to division of the same.... more than ten yrs & the property is yet to be divided) ... I would like to know if I can GIVE/GIFT/BEQUEATH MY SHARE(whatever it is) TO MY RELATIVE who also has a share in the same property.... despite the fact that teh shares are not yet done....

what should i do ? & how should i go about the same??

Dear Maria,

You may Gift your undivided share in the property to your relative, however the gift deed must mention that your share is not yet determined and the gift shall be effective upon determination of your share in the property by the court and the recipient would be able to gift/transfer/alienate with the property only after your share in the property is clarified.

Further please note that such gift deed would be treated as deed of conveyance and hence subject to payment of stamp duty on the current market value of your share being transferred by way of gift.
