I am writing to ask a question for my sister who lives in RI.  She is planning to seek a divorce and wanted to know, if she moves out, would it be considered abandonment of property.  Would he have to legally allow her back onto the property to obtain her possessions after she has moved out if she leaves some of her belongings on the premises?  Is there is a blanket law for most states regarding this, or are they individually different?

Dear K,

I am not an attorney and this is not legal advice, simply an idea.  Unless there is a history of violence or fear, the best plan of action would be to seek legal advice and draw up the paperwork before she moves, which should eliminate the possibility of any accusations regarding abandonment.  The papers can actually specify the terms for obtaining the rest of her property.  She can file the paperwork and still be out of the house before the papers are served.  Legal counsel will be needed for a divorce, anyway, so she might as well get the specifics before making any moves.
