Property survey markers 6 inches away from neighbor's fence in CA, can i put up my fence next to his fence?

Postby colfre » Thu Nov 24, 2011 4:42 pm

I live in CA at the same house for 8 years. Backyard fences are all from the neighbors since I'm looking at the back of their fences. The fences are in bad condition, wood rotting and having holes in it. I want to put up a white vinyl fence all around my house, so I got a property survey done. On the north side, the marker shows that the existing neighbor's fence is 6 inches away from the survey marker. On the south side, the marker is showing that the neighbor's fence is a couple inches encroaching on my property. My question is do I just put up a fence next to both the neighbors' fences, or do I have to put the fence along the property line? Since I have been living here for 8 years, and the adverse possession law requires only 5 years to claim ownership of the land, does this mean I own the land behind the fences that my neighbors had built?

Always best to put a fence in the correct place. Discuss this with your neighbours.

Errecting your own fence on your neighbour's property will trigger a request by him to remove it and will lead to permanent bad feelings so do not do it.

If you allow him to keep his fence on your property, without actually SAYING you allow it, he can presume you're aware of it, that it is "hostile" and he will legally own that slice of land (if he doesn't already) for your failure to evict him or give him permission to use your land for his fence.

as long as it doesn't cross into his property you should be alright, also you have ot make sure you don't damage his property when you put your fence it
