I live in CA at the same house for 8 years. Backyard fences are all from the neighbors since I'm looking at the back of their fences. The fences are in bad condition, wood rotting and having holes in it. I want to put up a white vinyl fence all around my house, so I got a property survey done. On the north side, the marker shows that the existing neighbor's fence is 6 inches away from the survey marker. On the south side, the marker is showing that the neighbor's fence is a couple inches encroaching on my property. My question is do I just put up a fence next to both the neighbors' fences, or do I have to put the fence along the property line? Since I have been living here for 8 years, and the adverse possession law requires only 5 years to claim ownership of the land, does this mean I own the land behind the fences that my neighbors had built?
