Pto And Getting It Paid Out.

Postby Rafaele » Sun Jun 08, 2014 4:08 pm

Hi, I recently quit working at a job where I had accrued PTO for vacation/sick leave. I also accrued disability PTO. I quit working there and due to the job switch was not able to finish my final 2 weeks. I was informed by someone(not an expert, or someone in management at the place of business) that I would be paid for my final PTO per the state of Ohio. They said that since I did not finish my 2 weeks notice I would not get paid for the disability PTO. I didn't get paid for any of it. The question is: Should I get paid for my PTO per state of Ohio law even if I didn't finish my 2 weeks out? Thanks in advance. Zach

Pto And Getting It Paid Out.

State of Ohio does not require that PTO or vacation time be paid out. You can only collect it if there is a handbook or contract that says you will be paid out the time if you terminate, or if others have terminated and been paid out the time.

If this is true than you can take the employer to small claims court and collect the PTO time. The state of Ohio does not help with this, to collect you must go to court and a judge must award the amount to you.
