Pushing A Small To Flee Their State To Non-custodial Parent

Postby Hrytherford » Mon Jan 20, 2014 9:14 am

My problem requires juvenile law in their State of: California
First, this isn't a few - but two male friends, among whom is likely to be 19 in about 3 months and another who's 17. The 17 y/o has try to escape at home on numerous occasions, and has evaded authorities and parents with the help of the 18 y/o. They're currently planning for a stumble upon state towards the 17 y/o non-custodial parent's home in Virginia (who not really have VISITATION privileges). What're the ramifications for the 18 y/o?

Encouraging A Minor To Flee The State To Non-custodial Parent

Partly depends upon how much they get. If apprehended in Florida then this (at least) applies:
PENAL CODE: AREA 277-280
278. Every individual, lacking the right to custody, who maliciously
takes, entices away, keeps, withholds, or covers any kid using the
Intention to detain or cover that kid from the legal custodian will
be punished by incarceration in a state jail not exceeding twelve months,
An excellent not exceeding a thousand dollars ($1,000), or equally that
fine and imprisonment, or by imprisonment in their state prison for
two, three, or four decades, an excellent not exceeding ten-thousand pounds
($10,000), or both that good and imprisonment.
I am sure Carl is likely to be along soon to complete the extra costs (adding to the delinquency, helping, etc).
When they get FREE FROM California, subsequently NATIONAL costs may come into play because of the transportation of the minor across state lines.
Quite simply, the 18-year old might have jail in his future.

Cheers. This is exactly what I believed... However, you know children, they believe they know everything and that people people are simply fools!
I simply wish the father may avoid the 'escape'. He is been informed of the intent.
*sigh*
