Question about labor laws?

Postby christie42 » Sun Jun 24, 2012 10:36 am

I work 2 jobs, 1 job at a waffle house (im both a cook and a waitor there), and at walmart (i am a stockman). And today I worked from 12:30 to 5:30pm at walmart and then had to come in at 9pm at waffle house with me finding out that a few hours before 9 (the manager texted me I had to). I didn't see that I was supposed to work from 9pm to 7am at waffle house till i got there. And I had to go in at walmart at 12:30 to 9:30 the next day. When I realized i was only going to get about 3 hours of sleep I told the manager that I wasnt going to be able to stay the whole time. She pretty much said you are going to have to get over it and she left. So I tried to call our district manager several times to see what options i had. I could never get ahold of her. Also, i posted my walmart schedule up a week and a half ago and they could see that I worked those hours the next day. Is this against the labor laws? Can I get fired if i leave? I love working at the waffle house and I definitely need two jobs right now but there is no way i could properly function safely on just 3 hours of sleep. especially since ive only been getting like 6 hours of sleep every night just because of the poor scheduling. (also i have waffle house work around my walmart hours bc it would be impossible to do the opposite because our waffle house is ALWAYS changing she schedule, sometimes hours before the shift started).

there nothing in the law that say they to give u time for another job, if working 2 jobs is the only way u can make ends meet then u may have to go without sleep sometimes I know it hard and sux but the law dosen't say anything about allow someone sleep time when they work 2 jobs

Unless you are a minor, or can prove that they are singling you out for harassment, I doubt you have any legal recourse. Businesses are not required to consider employee's other jobs when scheduling. Further, if there is a schedule made up, it is the employee's responsibility to know his schedule and deal with any conflicts ahead of time, even if the schedule wasn't available until that day. You can discuss this with your supervisor, or regional manner, to try and avoid future problems, however, if they tell you to be at work then you have to be there. They are within their rights to enforce attendance policies according to the schedule.
