Questions on NYS marijuana laws?

I wanted to know.
If a parole officer came to a house checking on someone on parol for a sexual offence.....if they by chance smell marijuana would they make everyone leave the house, call the police, and search the house?

If you are in a custody battle for a child, would everyone that comes in contact with that child HAVE to take a drug test even if there is no suspicion of drug use and no prior drug charges?


my boyfriends brother is trying to tell us that both of these things are true....and seeing that in NY a weed charge is the equivilant of a parking violation I don't see how these things are possible.

I have forwarded your confession that you have been caught smoking pot 20 times to the warrant department of the US Attorney General. Did you know that smoking pot is also a federal offense? Did you know that websites log your IP address when you post so we know who you are?

I bet you have smoked pot a bunch of times and not been caught too. Please post "additional details" confirming this.

Even though Marijuana has been decriminalized in New York I don't believe that means it will end searching and charges, especially when they are already looking for someone for a different offense. Getting someone on multiple charges is always the best.

As for the second part of your question I would speak with a lawyer as I am not familar with your state and or city laws. I would think if they have such a process in place then of course that would be how it works. However if this isn't the case then obviously you wouldn't have to worry about it.

As for a previous answer.....YES Marijuana in New York is a petty offense as long as it is under 25g. New York along with several other states have made possesion of smaller amounts petty offenses. ****In Alaska you are actually allowed to grow 24 or less plants (protection under Alaska's Constitution)

25 g or less (first offense) civil citation No Jail Time $100 fine
25 g or less (second offense) civil citation No Jail Time $200 fine.

It isn't until the third offense that it becomes criminal which then a misdemeanor which if its still 25g or less its only 5 days in jail or a fine of $250.

These fines are probably slightly higher than most parking tickets however but still nothing to scoff at.
