My Girlfriend was a permanent person for 30-yr but offered period 3 years for theft and arson, later the arson cost was fallen but after helping his period he was deported in 2002. If we got married might he re enter in 10 years or as a result of this offense is he considered inadmissible? Additionally his entire household is here now in addition to his child. Thanks for the time.

Deportation Question For Fiancee

Postby Beaufort » Mon Jun 09, 2014 7:41 pm

I'd really discovered another community that likewise offered me these details and really had an appointment having an attorney and so I believe I'm about the right course. Only one more issue although do you consider it'd be considered a waste of time for you to apply for a girlfriend waiver? I am thinking due to the kind of offense the likelihood of a girl visa could be refused quicker than if we were committed previously. Cheers for the period as well as your reaction

Deportation Question For Fiancee

Postby Raylen » Mon Jun 09, 2014 11:18 pm

Dear Lela,
Relationship might make a difference. You should look at planning an immigrant waiver (assuming you're committed). The most crucial aspects of a waiver are rehab and severe difficulty towards the U.S. spouse.
Before you need to do something about his immigration position, you need to consult a qualified U.S. immigration lawyer regarding this waiver/removal issue.
This response is within the character of common info, not legal counsel and really should not be depended on as such.
Deportation Question For Fiancee

Postby Kenan » Tue Jun 17, 2014 2:52 am

Hello,

There is no 'fiancee waiver'. Unless you he is married, he cannot file an immigrant waiver. However, there is a fiancee visa - K-1, but due to his record, he will probably be denied based on his inadmissibility.

Best regards,
Kenan
