Situation is a stacked duplex. one house upstairs (ours) and the basement converted to another house with a totally separate address.
Things we were told at first showing of the property..
That the big back yard was never occupied so our dog could play all day. (Deciding factor for move in)
That the neighbor downstairs lives by herself.
And only has one old small dog that was let out through the side door just to potty briefly.
That her grandkids visited on some weekends. (Explains the toys all over yard)
That her son stays there when he is in town for business.
That she gets the garage and the driveway.
That I could park my brand new motorcycle on the concrete patio in the back yard. (Deciding factor)
That the noise between units was very minimal (sound resistant/separate habitats)
That the trash and water bill was shared between the units.
That the unit downstairs rent is more than ours due to the garage and driveway use.
That downstairs only has one dog (1 Pet rent)
Would the landlord have to disclose to the new tenants that the Lower apartment runs a day care, with about 7 kids screaming and crying.We Were told at the time of looking at the house that the lady down stairs has her grand kids over from time to time on the weekends (not a daily daycare). ALSO no added floor insulation or sound dampening is present and you can hear everything through the floor and vents ...when we originally came to look at the place, the daycare advertisement sign in the yard was mysteriously gone that day. but after moving in, the sign just happened to appear out of nowhere two days later. that is just part of it...we pay the water and the trash for both units. Our dog has seen the back yard once since we moved in. which happened to be the day after we moved in. Didn't know at the time there was going to be a hyper/anxious boxer in the yard from 7 am to 10 or so at night. And watching her daughters dog a few times a week. They get the garage and the driveway, Yet we have to hope that we get a spot in front of the house for our parking, which is usually taken from the family or people dropping off or picking up there kids.. Sorry its so long, but i wanted to give you an idea of what we are going through and if it is against the law not to disclose these things BEFORE signing the lease. another deciding factor was that i was told my motorcycle would be safe to park in the back yard on the concrete patio to make up for not getting the garage....found out later its a liability to park it there in case one of the daycare kids dropped it on themselves.....you should also know that we pay $80 a month more than the downstairs neighbor not including the trash and water. And as it stands for our dog, we have to take him out front on a leash to try and play with him or potty. Thank you for your time, and any answers will help. location is colorado if that helps
