Hi. I live in Cook County Illinois.
Here is the situation. We signed a one year lease. On the day that we signed the lease they told us that we have to sign a one year contract other wise we have to pay additional $100 a month. If we sign a one year contract after one year we can do month to month no problem.

Our lease agreement require that we give 60 days notice before moving out and they will only accept the notice by the 1st of each month. Well we were going to stay until they notify us yesterday that the raise is going up $50 if we sign another one year lease and $200 without a one year lease.

Can they do this? If we know that they were going to raise the price we would have give them a notice at the end of last month. I don't think it's right they they waited this long to tell us that they will raise the price regardless of signing or not. I don't think that it's fair. I know $50 is not a lot but I still don't think that this price is legal. The letter should have came before the 1st of this month. Now we can't give notice till January first.

Rental leases are designed to protect the landlord, not the tenant, but you should check your lease and see if it says that the landlord must give you a certain amount of notice before raising the rent. If it has such a provision, and if the landlord violated it, then tell them that and inform them that you are giving notice immediately and moving out within 60 days. And enjoy being in the right! Otherwise, it's only one more month and $50 more dollars, and it's not like you're homeless or anything. Try to look on the bright side.
