Roommate broke the lease what now? good idea?

Postby tonibraxton » Wed Jul 18, 2012 12:01 am

So his mother in law owns this house we both rent from her but acording to the lease his step mother and himself and his exwife are our landlords. acording to the lease it states " This is to remain a drug free household" he been doing weed in the house I haven't said anything but am looking into moving out now. our lease is a very simple so what am thinking is writing up a notice saying they (him) broke our rental agreement there for we are giving our notice to be out by the 1st and we request our deposit and this month's rental back. what do you think? good idea?

Your roommate didn't "break" the lease. Your roommate might be in violation of the lease - but the lease agreement is apparently between your roommate and his MOTHER IN LAW.

Your roommate presumably does not have a lease agreement with you. But if your roommate DOES have a lease agreement with you (and assuming you are drug free), then the only option you have is to give him written notice that you will no longer tolerate him doing drugs in the house. If he does it again, then MAYBE you can move out with a minimum 30 days notice.

Under absolutely no circumstances would you EVER be entitled to a refund of this month's rent. And if you move out on August 1st, you will still be responsible for August's rent - because you didn't give written notice of your intent to move out on July 1st.

Finally, the only way you are entitled to your deposit back would be if you were current on your rent. You did not violate the lease agreement AND you didn't damage or dirty the house.
