Michael, the answer to this should be in your settlement. If you are unsure of what is said there talk to the lawyer that handled this for you. If there was no lawyer then talk to a lawyer that handles only workman's compensation cases. You need someone that specializes in this area. My own feeling is that once the case was closed it was done with. Your return to work signifies that and this injury would be considered a new case. Each state has there own set of rules so it would behoove you to read your state's workman's compensation book of rules.
